Draft Transportation Management Program Director's Rule

SDOT and SDCI have published a draft Joint Director's Rule for Transportation Management Programs ("TMP"), as SDCI 05-2021 / SDOT 01-2021. The Director's Rule establishes the responsibilities of property owners, applicants, and proponents of projects (the "Applicant/Responsible Party") subject to the Land Use Code or State Environmental Policy Act ("SEPA") requirements to develop a TMP. This Rule also identifies the ordinance authority and establishes the content, procedures, compliance, and reporting requirements of TMPs. The Rule is an update of the existing Joint Director's Rule for TMPs (DPD 27-2015 / SDOT 09-2015) and will supersede the existing rule once adopted.
  • This Joint Director's Rule clarifies the applicability and related authority of when a particular development proposal is subject to a TMP, either through SEPA review or Seattle Municipal Code (SMC) requirements.
  • This Joint Director's Rule updates the transportation mode share definition of a Single Occupancy Vehicle (SOV) trip to include any Transportation Network Company (TNC) vehicle or taxicab trip with one professional driver and one passenger, in addition to traditional SOV trips made in personally-owned vehicles.
  • This Joint Director's Rule updates various TMP program elements, some of which are required for all TMPs, and others of which may be recommended. A significant update in this Joint Director's Rule is a separate elements table, with accompanying narrative, for primarily residential projects. Additionally, some new suggested TMP program elements have been introduced that reflect trends in urban mobility over the last 5 years since the previous Director's Rule update, while others have been consolidated or deleted to better reflect the current state of the practice.
  • This Joint Director's Rule includes edits to the existing Rule to clarify processes and roles/responsibilities in the process of developing, implementing, and monitoring a TMP.

Environmental 

The draft rule(s) are located on the SDCI website. You can also obtain the rule(s) from the Public Resource Center, Seattle Department of Construction & Inspections (SDCI), Suite 2000, 700 Fifth Avenue, P.O. Box 34019, Seattle, Washington 98124-4019. SDOT has determined that this update will not have a probable significant adverse impact on the environment. As a result, SDOT has issued a Determination of Non-significance (DNS) on February 11, 2021. The decision was made after review of a completed environmental checklist. Public comments on the DNS and checklist will be accepted until 5:00 pm, March 4 2021, and the appeal deadline is March 11, 2021. Please see the DNS for more information on providing comments and submitting appeals.

Director’s Rules are administrative rules adopted according to the Administrative Code (Seattle Municipal Code Chapter 3.02). Public notice of all SDOT Director’s Rules is published in the City’s official newspaper, currently the Seattle Daily Journal of Commerce, prior to adoption.
