Leases vs Month to Month

If you have a terminating lease with your tenant and have never rented to that tenant on a month to month basis, the tenant must move out pursuant to the lease term.  You have the option of signing a new lease prior to the expiration of a terminating lease.

If you had an initial lease with your tenant that automatically converted to a month to month agreement, you must have a just cause reason to end the rental agreement. 

If you entered into a month to month agreement or accepted rent following the expiration of a lease agreement thereby creating a month by month agreement, you must have a just cause to end the rental agreement.

If a month to month agreement existed at any point during a tenancy, the tenant has rights under the just cause eviction ordinance and you cannot end the rental agreement without having a just cause reason.
