Contract Provisions
The Service Agreement is a performance-based contract with water quality standards that are higher than those required by state and federal regulations. That is, the Service Agreement stipulates output water quality and quantity requirements, but does not provide detailed specifications for facility design and construction. Some of the performance requirements and other facility features are listed below:
- • The facility must be capable of providing 120 million gallons per day (MGD) of treated water for raw water turbidities up to 15 NTU. Plant production is reduced at turbidities above 15 NTU. For example, 55 MGD of treated water will be produced at raw water turbidity of 40 NTU.
- • The facility must provide 3 logs (99.9%) of Cryptosporidium removal through filtration and inactivation (ozonation).
- • It must address upcoming disinfection by-product (DBP) regulations by providing water with less than 64 g/L total Trihalomethanes (TTHMs) and less than 48 g/L Halocetic Acids (HAA5) based on a simulated distribution system (SDS) test.
- • Residual disinfection will be provided using gas chlorination with flexibility to add ammonia for chloramination in the future.
- • Fluoride will be added at the new facility, as it has been at the existing facility.
- • PH and alkalinity will be adjusted (using lime and CO2) to allow us to optimize for corrosion control.
- • The facility includes redundant power and systems to ensure that treatment will continue even if the power supply is interrupted.
- • Azurix CDM is responsible for disposition of backwash solids. They are planning to utilize on-site disposal of the solids in drying beds.
- • There will be no pumping of finished water; the Tolt will remain a gravity supply.
- • The facility will have redundancy in all process units which ensures that at least 60 MGD plant capacity is available at all times, including scheduled plant maintenance.
- • Comprehensive, real time, plant operating information will be provided to SPU at its operations center.
- • The facility includes the following treatment processes: ozonation and flocculation (30 minutes detention time in a combined ozone contractor and hydraulic flocculation basin); and filtration with a maximum rate of 12 gpm/ft2.
In addition, there is an extensive facility maintenance and renewal and replacement program with mutual advantage provisions to both parties for facility upgrades.
The contract includes financial incentives for exceptional facility performance and liquidated damages for non-performance, addressing water quality, water supply, and regulatory compliance.
Other contract provisions include payment of prevailing wages to workers, subcontracting to women owned businesses at 8% of the total contract amount for design and construction (or about $5 million), and subcontracting to minority owned businesses at 21% (or about $14 million).
