Fees in Lieu

“In-lieu-fee” mitigation occurs in circumstances where a permittee provides funds to an in-lieu-fee sponsor instead of either completing project-specific mitigation or purchasing credits from a mitigation bank. Fees in lieu can be attractive for developers and also for a municipality. For example, if development is occurring in an area that already has robust pedestrian infrastructure, a developer might pay a fee instead of completing mitigation in that area. The fee could then by used by the city to enhance the pedestrian environment in another area that has less development underway.
