Policies - Environmental Due Diligence

An Executive Policy provided guidance for compliance with the 2006 EPA All Appropriate Inquires Rule and ASTM E1527-05 which clarifies the provisions to provide liability protections for certain property owners and transactions.

The purpose of environmental due diligence is to gather reliable information about the environmental condition of real property subject to a transaction. City decision-makers will use this information to decide whether to go forward with the transaction and, if the transaction is pursued, to structure the transaction to minimize legal liability and/or fairly allocate environmental risk and cost of any necessary cleanup. RES provides guidance to departments on real estate transactions, and encourages close coordination with the City’s Law Department to assure transactions are structured effectively.
