15.200 – Retail Theft Program

Effective Date: 10/17/2012

15.200–POL

This policy applies to arrests made by security officers working for stores that participate in the Retail Theft Program (RTP).

1. Definitions

Retail Theft Program – A voluntary program which allows a security officer working for a participating store to file misdemeanor trespass and theft cases without patrol officer involvement.

Security Incident Report (SPD form 5.14A) – Form completed by a store security officer that is routed directly to the Retail Theft Program for follow-up.

RTP Top Ten Offenders List – A list maintained by detectives assigned to the Retail Theft Program for the purpose of identifying chronic offenders. The RTP detectives request that officers book Top Ten Offenders arrested for RTP incidents and obtain witness statements from store security.

2. Detectives Assigned to the RTP Will Conduct Follow-up

Detectives will review all Security Incident Reports, conduct investigations, and forward cases to the City Attorney’s office.

3. Patrol Officers May be Dispatched to RTP Calls in Certain Cases

A security officer will request an officer response if the incident involves more than just misdemeanor theft or trespass, such as:

4. Officer Involvement in an RTP Call May be Limited to Verifying Suspect Identification

Security may continue processing the RTP case without further assistance, if an officer is only needed for verification of a suspect’s identity.

When verifying the identity of a suspect, officers will describe to store security the manner of verification and record it in the call log in CAD.

5. Officers Must Make an Independent Determination of Probable Cause Before Arresting a Suspect

6. Officers Shall Obtain a Statement or Security Incident Report if They Make an Arrest

These documents must be faxed to Data as soon as possible.

7. Officers Will Complete all Reports With the Same General Offense Number (GON) Used for the Security Incident Report

If Communications has already issued a GON to security, use that number. Otherwise, give security the GON of the dispatched call.

Do not use the originating GON of a warrant for incident paperwork.

8. If Officers Book an RTP Suspect for Warrants or Other Misdemeanor Charges, they Will Also Book the Suspect for the RTP Theft/Trespass

Include all relevant information regarding the theft/trespass incident and investigation. See 15.200-PRO-1 Misdemeanor Booking of RTP suspects.

9. Officers Will Obtain a Witness Statement and Statement of Value From the Security Officer for Felony or Top Ten Offender Arrests

15.200-PRO-1 Misdemeanor Booking of an RTP Suspect

When an officer books an RTP suspect for misdemeanor charges or warrants follow this procedure:

Security

1. Completes Security Incident Report

Officer

2. Verifies any warrants

3. Completes a GO report and a booking form including all relevant information regarding the theft/trespass incident and investigation

a. Uses the same GO number used for the Security incident report

  • If security has been issued a GON by communications, uses that number

b. Does not use the originating GON for a warrant for the RTP incident and booking

4. If the Suspect is Booked on Warrants, clears the Incident as a Warrant Arrest

a. Clear codes for RTP/warrant arrests:

  • Uses an “H” if booking under the GON provided to security by Communications
  • Uses an “A” if booking under the dispatched call GON

5. Faxes the security incident report or witness statements to the Data Center as soon as possible

a. If security cannot provide the documents to the officer at the scene, advises security to take the following measures:

  • Complete the documents as soon as possible
  • Fax the documents to the Data Center
  • Mail the original documents to the Data Center

 

15.200-PRO-2 Felony Booking of an RTP Suspect

When an officer books an RTP suspect for felony charges:

Security

1. Completes a witness statement and value statement

Officer

2. Verifies any warrants

3. Competes a GO report and a booking form including all relevant information regarding the theft/trespass incident and investigation

a. Uses the same GO number used for the Security incident report

  • If security has been issued a GON by communications, uses that number

b. Does not use the originating GON for a warrant for the RTP incident and booking

4. Faxes the witness statements to the Data Center as soon as possible

a. If security cannot provide the statements to the officer at the scene, advises security to take the following measures:

  • Complete the statements as soon as possible
  • Fax the statements to both the:
    • Data Center
    • Precinct Burg/Theft Unit
  • Mail the original documents to the Data Center
