Closed Case Summaries

OPA's Closed Case Summaries provide information misconduct complaints that are investigated by OPA. A Closed Case Summary is created for every case and is posted after the case has been completed. The Summaires provide information about a complaint, the allegations, information about the incident, the findings and discipline if applicable.

Each allegation associated with a complaint is given a "finding."  There are two options for findings: "Sustained" or "Not Sustained."  If the finding is "Not Sustained," it is noted whether or not it is Unfounded, Lawful and Proper, Inconclusive, Training Referral or Management Action.

Definition of Findings

Means the allegation of misconduct is supported by a preponderance of the evidence. Discipline may be imposed upon the named employee. Discipline is dependent upon the type of allegation and policy violation.

"Not Sustained (Inconclusive)" means the allegation of misconduct was neither proved nor disproved by a preponderance of the evidence.

"Not Sustained (Lawful and Proper)" means a preponderance of evidence indicates the alleged conduct did occur, but that the conduct was justified, lawful and proper.

"Not Sustained (Management Action)" means that due to a deficiency in policy or SPD procedures, no individual will be held accountable for an improper act or undesirable action. The OPA Director makes a recommendation as to how to change or improve the SPD policy or procedures.

"Not Sustained (Training Referral)" means while there may have been a violation of policy, it was not a willful violation and/or the violation did not amount to misconduct. The employee's chain of command will provide appropriate training, counseling to review SPD policies and address any inadequate training.

"Not Sustained (Unfounded)" means a preponderance of evidence indicates the alleged act did not occur as reported or is false.
