SUBJECT: Judge grants City’s request for $100,000 bail on groping charge

The alleged Westlake Park groper will remain in jail on $100,000 bail.

Daryl R. Sharma, already in violation of his probation from the state Department of Corrections, was charged by the City Attorney’s Office this week with one count of assault with sexual motivation. He faces a sentence of up to 364 days in jail and a $5,000 fine if convicted on the gross misdemeanor.

High bail was sought because the defendant has a lengthy criminal record and is a Level 3 sex offender, City Attorney Pete Holmes said after Sharma’s first appearance in court Friday morning. “My number one priority is public safety, and Mr. Sharma has shown he is not going to be able to control his impulses,” Holmes said.

The City alleges that on Oct. 12 the defendant, born July 6, 1978, groped a 27-year-old woman as she walked into a store near Westlake Park. Holmes thanked the woman, Julia Marquand, for tenaciously pursuing the incident through social media and Police Chief Kathleen O’Toole for dedicating police resources to apprehending Sharma. SPD continues to investigate Sharma for potential assaults on other women.

12A.06.010 Assault.

A. A person is guilty of assault when he or she intentionally assaults another person.

B. The City Attorney may file a special allegation of sexual motivation when the person intentionally assaults another person and one of the purposes for the assault was for the actor's sexual gratification. Such a special allegation must be proved beyond a reasonable doubt, with either the court making a finding of fact as to this special allegation if it finds the defendant guilty of assault or, if a jury trial is had, the jury finding a special verdict as to this special allegation if it finds the defendant guilty of assault.
