SUBJECT: Resolution in assault charge against SPD officer

SPD Officer Christopher Hairston on Tuesday entered into a 24-month dispositional continuance to resolve the misdemeanor assault charge brought against him by the City Attorney’s Office last April 3.

Hairston was charged after he was seen on video forcefully placing his hands on the face and neck of John Ross on Sept. 24, 2012, while Ross was in custody. Ross had been detained by officers after he assaulted Hairston’s wife, Officer Katherine Hairston. Ross was charged with third-degree assault in King County Superior Court and ultimately pleaded guilty to fourth-degree assault.

With today’s agreement in Seattle Municipal Court, Hairston’s case has been set over for 24 months. It will be dismissed on Jan. 28, 2016 if the officer successfully complies with the following conditions:

• Perform 120 hours of community service

• Have no unwanted contact with the victim

• Pay court costs, fine, and fees

• Have no criminal law violations

The maximum penalty for misdemeanor assault is 364 days in jail and a $5,000 fine.

An investigation of Hairston’s action is pending with SPD’s Office of Professional Accountability.
